CONSTITUTION
ARTICLE 1

NAME AND
PURPOSE
Section 1:
Name
Juvenile
Court, Community, and Alternative School Administrators of
California, a professional organization, serves as a
committee to the California County Superintendents
Educational Services Association (CCSESA), and shall be
known as JCCASAC. The acronym, JCCASAC, is pronounced
“J-sack”.
Section 2: The Official Logo

Purpose
3.1
The purpose of
JCCASAC shall be to:
3.1.1
Support student success;
3.1.2
Create a collegial network of
County
Office
administrators;
3.1.3
Research and share best
practices regarding new and innovative program
options for at-risk students;
3.1.4
Provide training and
assistance to new administrators;
3.1.5
Encourage legislation that
advocates for the learning needs of all students;
3.1.6
Give input and guidance to
the Superintendents relative to the diverse
needs
of our student population.

OFFICERS AND
REPRESENTATIVES
Section 1:
Titles
The officers
of JCCASAC shall consist of a President, President-Elect,
Secretary, Treasurer, Immediate Past President,
Legislative Representative and eight (8) Representatives
– four (4) from each of the two (2) sections. These
officers and section Representatives shall constitute the
Executive Board of JCCASAC. No county shall have more than
one (1) section representative, excluding officers.
Section 2: Powers
A majority of
the Executive Board shall exercise authority over all
organizational matters not provided for in this
constitution and by-laws. Executive board action requires
a quorum of the board (See By-laws, Article V).
Section 3: Elections
The President,
Secretary, Treasurer, and Representatives shall be elected
by the membership of JCCASAC by a mail-in ballot. The
President and President-Elect shall be selected from
different sections. All officers shall be active members
of JCCASAC. Ballots will be mailed no later than
forty-five (45) days prior to the annual conference, and
must be returned to the Chair of the Election Committee
with a post mark no later than the date indicated on the
ballot, which will be a minimum of two (2) weeks prior to
the annual conference.
A.
Eight (8) representatives, four (4) from each
section, north and south, shall be elected by the active
members of JCCASAC whose County Offices of Education are
located in the designated sections by mail in ballot.
B.
The four (4) section representatives shall be
designated as chairperson,
vice-chairperson, secretary, and member-at-large of that
section. No county shall have more than one (1) section
representative.
C.
In odd number years the following positions will be
elected:
(1) section Chair, (2) section Secretaries, (3) JCCASAC
Secretary and JCCASAC President (south). In even number
years the section Vice-Chairs, the section
Members-at-large, JCCASAC Treasurer, and JCCASAC President
(north) shall be elected.
The officers
will be announced at the annual conference.
Section 4: Term of Office
A.
The Presidency shall be a three (3) year term
comprised of President-Elect (year 1), President (year 2),
and Immediate Past President (year 3).
B.
The Secretary, Treasurer and section
Representatives shall serve a two (2) year term.
C.
The Legislative Representative is appointed by the
Executive Board and will serve at the discretion of the
board.
Section 5: Vacancies
In the event
of a vacancy in the office of President, the
President-Elect shall assume the office of President and
serve the remainder of the term. The President-Elect
automatically assumes the office of President at the end
of the President’s term of office. In the event that the
position of President-Elect is vacated, the chairperson of
the appropriate section assumes the role of
President-Elect, or, if that person is unable to serve as
President-Elect, the Executive Board shall appoint another
board member from that section. All other vacancies shall
be filled by the JCCASAC Executive Board, and the person
appointed shall serve until the next regular election.
Section 6: Duties of Officers and Section Representatives
Officers and
section Representatives are required to attend all JCCASAC
Executive Board meetings, section meetings, and other
meetings which require the participation of the officers
and/or section Representatives. Two or more absences will
result in a review by the executive board.

ORGANIZATION
Section 1:
Sections
For
administrative purposes, within the State organization of
JCCASAC, there shall be two (2) sections, a northern and a
southern section. The sectional dividing line shall be the
northern boundaries of
San Luis Obispo
, Kings,
Tulare
, and Inyo counties. The northern section shall include
all the counties north of this line, and the southern
section shall include all counties south of this line,
including the above-named counties.

MEMBERSHIP
Section 1:
Membership
This
organization shall consist of active, associate, and
honorary members.
Section 2: Eligibility
A.
Active membership shall be restricted to the
certificated personnel who are
County
Office
of Education (COE) Superintendent of Schools employees and
who supervise or administer programs within the Juvenile
Court, Community, and Alternative Schools of the various
counties, or who exercise supervisory or administrative
authority over the Juvenile Court, Community, and
Alternative Schools of various counties.
B.
Associate (non-voting) membership shall be open to
all others who wish to assist the Juvenile Court,
Community, and Alternative Schools Administrators of
California reach its goals.
C.
Honorary (non-voting) membership shall be open to
retired personnel who previously held active memberships.

DUTIES OF
OFFICERS
Section 1:
President
The President
shall:
A.
Preside over the business of the Executive Board.
B.
Serve as a representative to the Student Programs
and Services Steering Committee.
C.
Assume responsibility of JCCASAC activities:
1. Assign standing committees and
special committees.
2. Network with other agencies and
affiliated organizations.
D.
Represent JCCASAC to outside groups as appropriate.
E.
Provide oversight to JCCASAC website.
F.
Perform other duties as required.
Section 2: President-Elect
The
President-Elect shall:
A.
Assume the responsibilities of the President in
his/her absence.
B.
Coordinate and plan the annual conference with the
assistance of the conference committee.
C.
Perform other duties as assigned by the President
or the Executive Board.
Section 3: Secretary
The Secretary
shall:
A.
Be responsible for taking accurate minutes and
maintaining records of all
Executive Board meetings, and JCCASAC general meetings
held at the annual conferences.
B.
Distribute minutes to membership-at-large.
C.
Have available at all Executive Board meetings the
minutes of Executive Board meetings.
D.
Serve on the membership committee.
Section 4: Treasurer
The Treasurer
shall:
A.
Take responsibility for maintenance of all funds in
the JCCASAC treasury.
B.
Present budget reports at each Executive meeting
and at the annual conferences.
C.
Present any request for funds to the Executive
Board.
D.
Assume responsibility for a general business
account in which a balance shall be maintained for
operating expenses. All monies in excess of operating
expenses to be available to provide Grants-in-Aid to
students whose continued education would be unlikely
without this monetary assistance.
E.
Present financial records for review and audit as
requested. The records shall reflect income, expenditures,
and monthly beginning and ending balances.
F.
Chair the Budget Committee and the Membership
Committee.
G.
Serve as the Chair of the Scholarship Committee.
Section 5: Past President
The Past
President shall:
A.
Serve as chair of the election committee.
B.
Perform other duties as assigned by the President or the
Executive Board.
Section 6:
Legislative Representative
The
Legislative Representatives shall:
A.
Serve
as a legislative representative to SPSSC
B.
Represent
JCCASAC on legislative committees
C.
Attend
State legislative sessions as needed
D.
Review
and research past, current and pending legislation
E.
Provide
regular legislative updates at Executive Board meetings
and to JCCASAC membership.
F.
Coordinate
the approval of position papers and official documents
under the direction of JCCASAC Executive Board.

RATIFICATION
OF CONSTITUTION
This
Constitution shall take effect when ratified by majority
of the voting membership.

BY-LAWS
By-Laws of the
organization shall be established and ratified by the
Executive Board and shall include procedures for
amendments of this constitution and of the By-Laws
themselves.
Nothing in
these By-Laws shall contradict the contents of the
Constitution.

COMMITTEES
Section 1: Committee Appointments
All committees
of this organization shall be appointed by the President
and ratified by the Executive Board.
A.
A member may serve on more than one committee.
B.
Members of the Executive Board may serve on
committees.
Section 2: Standing Committees
A. Election
Committee
1.
The Election Committee shall consist of three (3)
members.
2.
The chairperson of the Election Committee shall be
the immediate past president.
3.
Nomination forms will be mailed to all active
members by January 31st. Completed nomination forms must
be postmarked no later than March 1st
and returned to the chairperson of the Election Committee.
4.
The Election Committee shall mail their slate of
candidates to the active members a minimum of forty-five
(45) days prior to the annual conference. Write-in
nominations will be accepted on the mail-in ballot.
B. Membership
Chairperson
1.
The Membership Chairperson shall be the Treasurer.
2.
The Membership Chairperson shall follow the
guidelines set up to determine eligibility of the members
and work for recruitment and retention of membership.
3.
The membership chairperson shall maintain and
distribute the membership list to all JCCASAC members.
C. Scholarship
Committee
1.
The Scholarship Committee shall consist of three
(3) members, one of whom shall be the JCCASAC Treasurer.
2.
The chairperson of the Scholarship Committee shall
be the JCCASAC Treasurer.
3.
The Scholarship Committee shall follow the
guidelines set up to determine the eligibility of
students.
4.
Reports of the Scholarship Committee shall be made
to the Executive Board.
5.
The Scholarship Committee shall submit a report at
the spring conference.
D. Information
and Communication Committee
1.
There shall be three (3) members on the JCCASAC
Information and Communication Committee, comprised of the
northern and southern section secretaries and chaired by
the JCCASAC secretary.
2.
The JCCASAC Journal shall be published at least
annually.
3.
The JCCASAC Information and Communication Committee
shall assist the President with the oversight of the
JCCASAC website.
E. Legislative
Task Force
1.
The Legislative Representative shall chair the
Legislative Task Force as needed.
2.
The Legislative Task Force shall be appointed by
the Executive Board.
F. JCCASAC Journal Committee
1.
The Journal Committee shall be chaired and edited by a JCCASAC member appointed by the Executive Board. In recognition of the time needed to coordinate the development and publication of the Journal, the chair shall be paid an annual stipend with the amount to be determined by the Executive Board. The chair will be assisted by other JCCASAC members and county office employees.
2.
Duties of the Journal Committee shall include: Direct and oversee the publication of the annual JCCASAC Journal; Solicit articles from the membership; Coordinate sponsors and advertisers.
3.
The JCCASAC Journal shall be published at least annually.
4.
The chair of this committee will be responsible for the distribution of the JCCASAC Journal. At a minimum, the JCCASAC Journal will be distributed to the membership and to the County Superintendents. Other recipients of the Journal may include members of the Legislature or State government and will be decided by the Executive Board on a yearly basis. The chair also will maintain a list of who has received the Journal on a yearly basis.
Section 3: Subcommittees
There shall be
such subcommittees as the JCCASAC Executive Board may
determine. These may include but are not limited to
special education, charter schools, home education,
opportunity classes, and independent study.

MEETINGS
Section 1:
Meetings
The President
shall call a minimum of one (1) general meeting, in
conjunction with the annual conference held in the spring,
alternating northern and southern locations. The President
may call other meetings as deemed necessary. The section
chairs shall call membership meetings in conjunction with
the annual conference or as needed. Special meetings may
also be called by any member with the approval of the
majority of the members of Executive Board of JCCASAC.
Section 2: JCCASAC Meetings
JCCASAC shall
hold no less than four (4) meetings each year, two (2) in
each section. Executive Board shall meet prior to each
JCCASAC meeting. Each
county is entitled to two (2) official meeting
participants. Executive Board will hold a July work group
meeting in order to identify and prepare goal focus areas
and agenda priorities for the upcoming school year.
Section 3:
Notification of Meeting
Announcement
of the general membership meeting shall be made in writing
to all members in good standing thirty (30) days prior to
the date of the meeting.

DUES
Section 1:
Rates
The dues of
this organization shall be set by the Executive Board.
Section 2: Membership Status
An active or
Associate member is considered in good standing if her/his
dues are paid for the present school year.
Section 3: Honorary Members
There shall be
no dues for honorary members.
FEES
Annual meeting
fees will be collected from each county.
Fees collected shall be used to defray costs of:
meeting room rentals, refreshments, programs,
reprographics, mailings, and other related expenses
approved by the Executive Board.
Meeting fees shall be recommended and approved by
the Executive Board and revised as necessary.

VOTING
Section 1:
Eligibility
Only active
members who are in good standing shall be allowed the
privilege of voting.
Section 2: Voting Process
Based on a
directive of the Executive Board, a majority of the active
membership present at the general meeting or a majority of
returned ballots by mail shall be necessary to amend the
Constitution. There shall be no proxy voting at any
election on any issue.

QUORUM
Section 1:
Membership Meetings
A Quorum shall
consist of the active members present at any officially
scheduled meeting.
Section 2: Executive Board Meetings
A simple
majority of the Executive Board must be present to
constitute a Quorum.

RATIFICATION
Section 1:
Ratification
These By-Laws
shall be modified in the same manner as prescribed in the
Constitution or by a two-thirds vote of the Executive
Board.

Robert’s
Rules of Order, Revised, shall regulate the conduct of all
general meetings.

AMENDMENTS
Section 1:
Proposed Amendments
Amendments to
these By-Laws and the Constitution may be proposed by any
member via organizational channels in written form.
Section 2: Presentation of Amendment
Amendments to
this Constitution or By-Laws must be presented to the
Executive Board in written form thirty (30) days prior to
the JCCASAC general meeting.
Section 3: (Required Majority) Constitutional Amendment
Based on a
directive of the Executive Board, a majority of the active
membership present at the general meeting or majority of
returned ballots by mail shall be necessary to amend the
Constitution.
Section 4: (Required Majority) By-Laws Amendment
A majority of two-thirds of the Executive
Board is necessary to amend these By-Laws.
